JOWIE IRUNGU FOUND GUILTY IN MONICA KIMANI MURDER CASE, MARIBE FLEED.
"Having considered the evidence in this matter it is the finding of this court that the prosecution has adduced adequate evidence and has met the threshold.... It is the finding of this court that the first accused person murdered the deceased," wrote Justice Grace Nzioka.
The businesswoman Monica Kimani's murder has been proven to be the work of Joseph Irungu, also known as Jowie.
"Having considered the evidence in this matter it is the finding of this court that the prosecution has adduced adequate evidence and has met the threshold.... It is the finding of this court that the first accused person murdered the deceased," wrote Justice Grace Nzioka.
In addition to Irungu, former TV newscaster Jacque Maribe was also accused of murder; however, she was found not guilty.
"After reviewing the evidence in this case, the court finds that the prosecution has met the requirements and presented sufficient evidence. This court finds that the initial accused individual killed the deceased," declared Justice Grace Nzioka.
She continued, "The first accused person stole the ID of Dominic Bisera two days before the commission of the offense, armed himself with a gun, carried a Kanzu, put it over his clothes, went to Lamuria gardens, disguised his identity, gained access to the apartment of the deceased, murdered the deceased, left the deceased's house, changed his clothes and eventually went home and burnt the clothes which he wore during the commission of the offense."It's the discovery
"It is the finding of this court that all this evidence taken cumulatively leads to a strong conclusion that the first accused person murdered the deceased," stated Justice Nzioka.
In Maribe's case, the judge determined that the prosecution's evidence did not establish her presence in the deceased's home on the fateful night, clearing her of all charges.
"She had never spoken to the dead, according to the evidence. The prosecution's evidence on the second accused party pertains to the shooting incident that occurred on September 20, 2018, as Justice Nzioka pointed out.
The judge did, however, draw attention to the fact that Maribe had been discovered to have provided contradicting information when she was recording her earlier remarks regarding how Jowie had been shot, classifying the offense as providing false information to a public worker.
Regarding this, the judge stated that the Director of Public Prosecutions (ODPP) office has the authority to determine the best course of action.
"The DPP office is aware of its responsibilities. The conclusion is that the prosecution did not present sufficient evidence for this court to convict the second accused party of killing Monica Nyawira Kimani on September 19, 2018.
Since then, the court has revoked Jowie's bond, and he will stay in detention until March 8, 2024, when the sentence will be handed down.
