On the request of a 22-year-old woman who believes she is the child's sibling, the high court in Eldoret has decided not to intervene in the burial of World Marathon record holder Kelvin Kiptum.
In response to a motion from Edna Owuor via her attorney Joseph Oyaro, Justice Wananda denied halting the burial.
If the burial is not prevented, she says, their one-year-and-seven-month-old child's rights might be infringed.
Owuor went to court with the child attempting to prevent the planned funeral for tomorrow, claiming that she was not included in the planning process.
She also desired bodily DNA samples to be obtained to establish paternity.
According to Wananda, it would be unjust to halt the burial because it had been planned for a while and had incurred significant expenses.
