EACC FILES A LAWSUIT AGAINST RUBIS KENYA SEEKING SH1.6 BILLION OVER CITY LAND
According to the agency's findings, all land officials were allegedly involved in the allegedly irregular alienation and allocation of the land to private entities.
In response to Rubis Energy's purported purchase of public land that belongs to Kenya Railways Corporation, the Ethics and Anti-Corruption Commission has filed a lawsuit in hopes of recovering Sh1.6 billion.
Former commissioners of lands from 1975 to 1999 are the targets of a lawsuit brought by EACC.
Another person suing is the former Lands Ministry director of physical planning.
According to the anti-graft agency's lawsuit filings, the former land officials gave the land to private companies in an irregular manner.
This property refers to the section where Rubis's headquarters are located, at the intersection of Haile Selassie Avenue and Uhuru Highway.
According to EACC, the site was initially set aside for Kenya Railways and then turned over so that a flyover could be built to relieve traffic in Nairobi.
According to the agency's findings, all land officials were allegedly involved in the allegedly irregular alienation and allocation of the land to private entities.
"EACC claims that because the land was alienated for public services, it could not be allocated. Therefore, according to EACC's affidavits filed with the Environment and Land Court in Nairobi, "the defendants' purported alienation and creation of LR Nos. 209/9641 and 209/12133 was fraudulent, illegal, and null and void."
The former land officers are charged by the government with illegally disposing of public property.
Additionally, it charges Rubis with intentionally and dishonestly attempting to alienate public land that has already been alienated.
"As such, the defendants were in breach of their fiduciary duties by purporting to alienate the suit property."
The Anti-graft office further claims that despite Kenya Railways' pleas, Rubis has refused to turn over the land to the government.
EACC demands Sh1.6 billion from the company in recompense for the land's years of private use.
