JOWIE CONTESTS THE DEATH PENALTY, CLAIMING IT IS CRUEL AND INHUMAN.

Joseph Irungu, also known by his stage as Jowie, a murder suspect who has appealed a High Court decision that sentenced him to death for the killing of businesswoman Monica Kimani.
Jowie claims that his constitutional rights are violated by the punishment imposed by Lady Justice Grace Nzioka on March 13, 2024, according to court documents obtained by Citizen Digital.
For this reason, he requests that the court rule that the death sentence is "a degrading form of punishment prohibited under Article 25 of the Constitution" and that it is "torture, cruel, and inhumane."
He additionally seeks: "A declaration that Section 379(4) of the Criminal Procedure Code is unconstitutional, null, and void to the extent that it denies persons sentenced to death the right to bail pending appeal."
In addition, Jowie has requested that the court rule that the March 13 sentencing violated his inalienable right to be free from torture and cruel, inhuman, or humiliating punishment.
In addition, he demands damages "for violation of his rights under Kenyan Constitution Articles 27, 28, 29, 48, and 50."
Jowie, 33, was convicted of Kimani's murder. On September 19, 2018, Kimani was brutally murdered in her Nairobi residence in Lamuria Gardens.
According to Justice Nzioka, Monica Kimani's horrifying murder was "intentional."
