A 45-year-old man who committed incest against his 13-year-old daughter was given a life sentence.
This is against the Sexual Offenses Act No. 3 of 2006, Section 20(1).
A "term which shall not be less than five years but which may be enhanced to imprisonment for life" is the penalty for the crime.
Additionally, in violation of Section 11(A) of the Sexual Offenses Act No. 3 of 2006, the man was found guilty of an indecent act. Section 11(A) of the Act provides that "Any person who commits an indecent act with an adult is guilty of an offense and liable to imprisonment for a term not exceeding five years or a fine not exceeding fifty thousand shillings or to both".
The accused was chastised by Magistrate Olivia Koranje for not altering his conduct despite his prior conviction and sentencing.

Following his release, the father proceeded to commit the charges against his daughter at Nyacha village, Taru location within Kwale County, on various dates between January 2019 and March 26, 2023.
Counsel Annette Wanjohi on behalf of the prosecution called five witnesses, one of whom was the juvenile, to support its case.
Following the trial, Magistrate Koranje declared that there was no reasonable doubt in the case because of the evidence presented to the court.
She rejected the accused's unfounded position that he was set up by his wife, noting that the medical report supported the statements made by witnesses.
