A PETITION HAS BEEN FILED TO REMOVE CHIEF JUSTICE MARTHA KOOME FROM HER POSITION.
"While appointing persons to serve at the tax appeal tribunal, the judge failed to be honest in the execution of powers conferred to her by the Tax Appeal Tribunal Act based on powers conferred to the judge as a judicial officer...," the petition begins.
The Judicial Service Commission (JSC) has received a petition asking for Chief Justice Martha Koome's resignation.
Michael Kojo Otieno, the petitioner, alleges that the Chief Justice disregarded the law when choosing the tax appeal tribunal's members.
"While appointing persons to serve at the tax appeal tribunal, the judge failed to be honest in the execution of powers conferred to her by the Tax Appeal Tribunal Act based on powers conferred to the judge as a judicial officer...," the petition begins.
Kojo contends that the CJ lacked diligence and transparency and that she discriminated against those who had applied to join the board.
"The actions of the chief justice in appointing members more than the stipulated requirement violated section 4b of the Tax Appeal Tribunal Act," Kojo asserts.
He contends that the chief justice ought to be removed from office due to the reasons/arguments mentioned above.
According to the records obtained by Citizen Digital, "the chief justice's actions in the tax appeal tribunal's appointment are illegal, null and void, and hence unfit to hold public office."
