This setback is only temporary! Ahmednasir said that following the Court of Appeal's decision on Friday regarding the housing levy, Senior Counsel Ahmednasir Abdullahi entered the room.

President William Ruto's housing program suffered a temporary delay, according to the lawyer, who announced on his X account.

"Today's ruling by the Court of Appeal quashing the Finance Bill 2023-24 is a mere temporary setback," stated Ahmednassir.

The Head of State's program, the lawyer said, is lofty and visionary, and it includes the housing levy.

The President should go back to the drawing board and find a solution, Ahmednasir urged.

"President Ruto and his group need to start again and find a workable solution. We can't put these fantastic ideas on hold for a day and then give up on them completely," he continued.

The Court of Appeal refused to postpone rulings that would have prevented the government from taking Kenyans' housing taxes on Friday.

In rejecting the state's plea, Justices Lydia Achode, John Mativo, and Gatembu Kairu argued that the public interest resides in waiting for the appeal to be resolved.

"This is because if the stay sought is granted at the stage, should we affirm the challenged decision, then some far-reaching decisions that will have been undertaken under the challenged laws may not be reversible," they stated.

"Public interest in our view tilts favour of in not granting the stay or the suspension sought," they stated.

They claimed that hearing the appeals first would serve the public interest.

As a result, the housing levy continues to be suspended as the High Court had ordered. 

The High Court declared the deductions to be unlawful, and the Attorney General and the National Treasury then moved to the appellate court.

They warned the court that the suspension would cause widespread uncertainty and a severe budgetary problem.

They requested injunctions to prevent the High Court ruling that the housing charge was unlawful from taking effect while their appeal was being considered.
